Penalty for Employers Who Do Not Take OHS Training


By Article 17 of the Occupational Health and Safety Law No. 6331; employers ensure that employees receive occupational health and safety training. OHS training is given before employees start work, on the job, field training, job changes, equipment-production method changes, returning to work of an employee who has an illness or an accident, or at periods that vary according to the hazard class and during the periods stipulated by the legislation.


Informing the employees against the existing dangers in the workplace, informing the safety and health rules to be followed according to the situation of the work they will do or the workplace they are in, ensuring that the employees avoid actions that may endanger their lives, ensuring that the necessary measures are taken to prevent occupational accidents and diseases that may occur, and occupational health and safety awareness in all employees OHS training are given to the employees to create.

Employers are obliged to fulfill the following conditions regarding the OHS training of their employees:

1- Preparation and implementation of training programs,
2- Providing suitable venues, tools, and equipment for training,
3- Ensuring the participation of the employees in these training and recording their participation in the minutes,
4- At the end of the training, he is responsible for issuing training certificates for the participants.

Occupational health and safety training is organized at specified times and periods by the workplace hazard class determined according to the workplace NACE code. At least once a year and for at least 16 hours in workplaces in very dangerous class, at least once in 2 years and at least 12 hours in workplaces in dangerous class, at least once in 3 years and at least 8 hours in workplaces in less hazardous class. hours for each employee.

Employers who do not fulfill their obligations outlined in Article 17 of Law No. 6331 are subject to an administrative fine of 3,138 TL, valid in 2023, per employee for each violation.
